These Terms & Conditions govern your use of brahmmemone.com.
They also apply, where relevant, to your purchase of or participation in programs, courses, events, training, coaching, digital products and other services offered by Brahm Memone.
Please read these Terms before using this website or making a purchase. By using this website, you agree to these Terms. Nothing in these Terms limits any rights you may have under applicable consumer protection or other laws.
Brahm Memone provides leadership development, personal development, communication training, educational programs, research, commentary, speaking and related content.
This includes work associated with The Human Lab, Pro Speak & Lead, and other programs, publications, events and services offered by Brahm Memone.
The content on this website is provided primarily for educational and informational purposes.
The specific content, format, duration, schedule, price and inclusions of a program or service will be described on the relevant webpage, registration page or purchase page.
Programs may include live online training, recorded video training, downloadable materials, group discussions, Q&A sessions, exercises, online communities or other learning resources.
We may improve, update or modify program content from time to time where doing so does not materially reduce what was purchased.
Any material change to a program that affects a purchaser's participation will be communicated where reasonably practicable.
Private coaching, consulting, keynote speaking and other individually negotiated services may be governed by a separate written agreement. Where there is a conflict between that agreement and these Terms, the separate agreement will govern that particular engagement.
Some programs, events or services may have specific eligibility requirements. These will be identified where applicable.
Participants are expected to engage professionally and respectfully with Brahm Memone, facilitators, guests and other participants.
We reserve the right to remove a participant from a live session, online community or program where their conduct is abusive, threatening, deliberately disruptive, unlawful or substantially interferes with the experience of others.
Where removal results from serious misconduct or a material breach of these Terms, a refund will not normally be provided, subject to applicable law.
Prices, currencies, taxes and payment options will be displayed before you complete a purchase.
Where prices are stated in a currency other than Canadian dollars, the currency will be identified.
You are responsible for ensuring that the information you provide when making a purchase is accurate and that you are authorized to use the selected payment method.
If an instalment payment option is offered, the payment schedule and total purchase commitment will be disclosed before purchase. Selecting an instalment plan does not make the program a month-to-month subscription. The purchaser remains responsible for the full agreed purchase price, subject to any rights provided by applicable law.
We may use third-party payment processors to process transactions. Payment information may therefore be handled directly by the relevant payment provider in accordance with its own terms and privacy practices.
All purchases are final and non-refundable unless otherwise required by applicable law.
Please review the program description, dates, format, price and other relevant information carefully before completing your purchase.
A decision not to attend, participate in, complete or use a purchased program, course, event, digital product or service does not, by itself, create an entitlement to a refund.
If payment is being made by instalments, withdrawal from or non-participation in the program does not cancel the remaining agreed payments.
If Brahm Memone cancels a paid program or event and does not provide a reasonable alternative, affected purchasers will be offered an appropriate remedy, which may include transfer to another date or program, credit or refund.
Nothing in this section removes or limits any cancellation, refund or other consumer right that applies under law and cannot legally be waived.
Where you purchase access to online training, video courses, recordings or other protected digital content, your access is for your own personal use unless otherwise stated.
You may not share login credentials or provide unauthorized access to another person.
Access periods, where applicable, will be disclosed as part of the relevant offer.
We may suspend or terminate access where there is evidence of unauthorized sharing, copying, redistribution or other material misuse of the content.
Unless otherwise stated, all original content made available through this website and our programs remains the intellectual property of Brahm Memone or the applicable rights holder.
This includes, without limitation, written material, videos, recordings, presentations, course materials, frameworks, methodologies, graphics, exercises, worksheets, program architecture, branding and other original educational material.
Purchasing a program or accessing free material does not transfer ownership of that intellectual property to you.
You may use materials provided to you for your own personal learning and development.
Unless you have written permission, you may not reproduce, sell, license, publish, distribute, commercially exploit, substantially copy or make our protected materials available to others.
You may not upload substantial portions of paid or protected course materials to public repositories, content-generation systems, artificial intelligence training systems or other services for the purpose of reproducing, redistributing or creating derivative commercial materials from our intellectual property.
Nothing in this section is intended to restrict any use permitted by applicable copyright law.
You retain ownership of original material that you create.
If you participate in a program and develop your own speech, presentation, story, business concept, intellectual property or other original work, that work remains yours.
Participation in Pro Speak & Lead, for example, does not give Brahm Memone ownership of a participant's signature presentation merely because it was developed or refined during the program.
Where participants voluntarily contribute comments, questions, examples or discussion during a live session, those contributions remain subject to any recording or livestream notice provided for that session.
Some live programs, training sessions, workshops, interviews or events may be recorded or livestreamed.
Where a session is being recorded or livestreamed, participants will be given an appropriate notice in connection with registration, entry or participation.
The applicable notice may explain how a participant's name, image, voice, comments, questions or other contributions may appear in a recording or public livestream.
Because livestreamed material may be transmitted publicly in real time and may subsequently exist on third-party platforms, it may not always be possible to retrieve or remove material after it has been publicly transmitted.
Participants who do not wish to appear or contribute in a recorded or livestreamed environment should follow the participation options or instructions provided for that particular event.
Our programs are designed to provide education, development, training, frameworks, tools and opportunities for practice.
Human development depends upon many factors, including the participant's circumstances, decisions, effort, experience and application. We therefore do not guarantee any particular personal, professional, financial, business, speaking or career result.
Examples, testimonials, case studies and participant experiences illustrate individual experiences. They should not be interpreted as guarantees that another person will achieve the same outcome.
You remain responsible for your own decisions and for how you apply the ideas and material provided.
Unless expressly agreed otherwise in writing, content provided through this website, The Human Lab, courses, presentations, publications and training programs is educational in nature.
It should not be treated as legal, medical, financial, accounting, psychological or other regulated professional advice.
Where a matter requires professional advice specific to your circumstances, you should consult an appropriately qualified professional.
We may use third-party services to operate the website and deliver programs, communications and events. These may include services for video hosting, livestreaming, video conferencing, payments, email, website functionality and other business operations.
Examples may include platforms such as Zoom, YouTube, Vimeo and other service providers.
Your use of a third-party platform may also be governed by that provider's own terms, privacy policies and technical requirements.
We are not responsible for interruptions, outages, policy changes or other matters outside our reasonable control that arise from independently operated third-party services.
We aim to keep this website and its content accurate and available, but we do not guarantee that every page, feature or service will always operate without interruption or error.
The website may contain links to third-party websites or resources. A link does not necessarily constitute an endorsement of everything contained on that website.
We are not responsible for the content, availability, security or privacy practices of websites operated by third parties.
You may not use this website, its systems or its content to engage in unlawful activity; interfere with the operation or security of the website; attempt unauthorized access to accounts or systems; distribute malicious code; scrape or systematically extract protected content for unauthorized commercial use; impersonate another person; or infringe the intellectual property or other legal rights of Brahm Memone or another party.
Reasonable use of publicly available website content for ordinary browsing, reference, commentary and other lawful purposes is not restricted by this provision.
To the fullest extent permitted by applicable law, Brahm Memone will not be liable for indirect, incidental, special or consequential loss arising solely from the use of this website, educational content or services.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
Nothing in these Terms removes any statutory warranty, consumer protection, remedy or other right that cannot legally be waived or restricted.
Personal information collected through this website or in connection with our programs and services is handled in accordance with our Privacy Policy and applicable law.
Cookie and similar technology practices are addressed through our cookie consent system and related information provided on this website.
If you choose to subscribe to emails or other marketing communications, we may send you material relating to our programs, ideas, events, publications and other relevant work in accordance with applicable law.
You may unsubscribe from marketing emails using the unsubscribe mechanism provided in those communications.
Operational communications relating to something you have purchased, registered for or requested may still be sent where necessary to provide the service.
We may update these Terms from time to time to reflect changes in our services, business practices, technology or legal requirements.
The current version will be published on this website with the date of the latest update.
Changes will not retroactively remove rights that have already arisen under an existing purchase or agreement.
These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without limiting any mandatory rights that may apply to a consumer in another jurisdiction.
Any dispute relating to these Terms that cannot be resolved directly will be dealt with in accordance with applicable law.
If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
Questions about these Terms, a purchase, program access or another matter relating to our services may be submitted through the Contact page on brahmmemone.com.
